The proposal would align New Jersey more closely with jurisdictions that already restrict height and weight discrimination. Michigan provides similar protections, and the New York City Human Rights Law prohibits unlawful discrimination based on height or weight in employment, housing, and public accommodations.
Exceptions for Job Requirements and Safety
Bill S1631 would not ban every height- or weight-based requirement. A distinction may still be permitted when height or weight is a bona fide occupational qualification or when a legitimate safety consideration applies.
